Terms and Conditions (T&C) – jpnboosted
1. Scope and Contracting Party
These Terms and Conditions (T&C) apply to the use of the booking platform jpnboosted.com. The contracting party for the intermediary contract is:
Ilias Ammour, Altes Gericht 22, 35398 Giessen, Germany (hereinafter "jpnboosted" or "Intermediary").
2. Role of jpnboosted (Intermediary Service)
- jpnboosted operates an online platform through which customers can reserve experiences in Japan.
- jpnboosted acts exclusively as an intermediary. We organize the reservation, scheduling, and communication between the customer and the executing partners.
- The actual execution of the driving experience and the provision of the vehicles are carried out by independent local service providers in Japan (hereinafter "Local Providers").
- jpnboosted does not conduct experiences itself and does not provide its own vehicles for the tours in Japan.
3. Conclusion of Contract (Two-Contract Model)
By completing the booking process on jpnboosted.com, two separate legal relationships are established:
- Intermediary Contract: A contract for the mediation of a experience is concluded between the customer and jpnboosted. Our service is fulfilled as soon as the reservation is confirmed and transmitted to the Local Provider.
- Execution Contract: The contract for the actual tour is concluded exclusively between the customer and the Local Provider in Japan. The conditions for the execution (e.g., fitness to drive, local liability) are governed by the agreements with the Local Provider and its respective law.
4. Prices and Payment Terms
- The total price shown on the platform consists of an intermediary fee (booking fee) and an execution fee (remaining balance).
- Booking Fee (Intermediary Fee): Upon booking, a non-refundable deposit (e.g., ¥10,000) is due, which is paid to JPN Boosted via the payment provider Stripe. This fee covers the costs of the intermediary platform and the reservation.
- Remaining Balance (Execution Fee): The remaining balance must be paid by the customer on the day of the experience directly and in cash (JPY) to the Local Provider in Japan. jpnboosteddoes not collect this amount.
5. Cancellation, Delay, and No-Show
- Free Cancellation: A refund of the booking fee (intermediary fee) is possible if the cancellation is made within 24 hours after booking AND the start of the experience is still at least 48 hours in the future at the time of cancellation.
- Retention of Booking Fee: Since the intermediary service begins with the reservation and blocking of resources with the local partner, the booking fee will be fully retained as compensation for expenses in the event of later cancellations or no-shows.
- Delays: If the customer arrives at the meeting point more than 15 minutes late, the local partner has the right to cancel the tour without refunding the booking fee (No-Show).
6. Conditions of Participation (Documents & Behavior)
The customer is responsible for meeting the requirements for the experience. jpnboosted is not liable for a cancellation due to the following reasons:
- Driver's License: Customers who wish to drive themselves (if allowed as part of the experience) must present a valid passport, their national driver's license, and an original International Driving Permit according to the 1949 Geneva Convention (Exception: official JAF translation for countries with bilateral agreements, e.g., Germany, Switzerland). Driving is strictly prohibited without these documents.
- Zero Tolerance: Japan has a strict zero-tolerance policy (0.0% BAC) for alcohol and driving. At any sign of alcohol or drug consumption, the tour will be immediately terminated by the local partner without refund.
- Code of Conduct: Dangerous driving, street racing, drifting on public roads, or disrespectful behavior at meeting points may result in the immediate termination of the tour by the local partner.
7. Liability of jpnboosted
- Liability as Intermediary: jpnboosted is only liable for the proper mediation (e.g., correct transmission of booking data). We are liable for intent and gross negligence. For simple negligence, we are only liable for the breach of essential contractual obligations, limited to the foreseeable typical damage.
- Disclaimer of Liability for Execution: jpnboosted is not the tour operator. jpnboosted does explicitly assume no liability for personal injury, death, or property damage that occurs during the execution of the experience in Japan (e.g., due to traffic accidents, misconduct of the local driver, or technical defects of the vehicle).
- All contractual or statutory claims for damages arising from the execution of the experience must be made exclusively and directly against the Local Provider in Japan.
8. Cancellation by Provider / Force Majeure
If a local partner has to cancel the tour due to extreme weather conditions, vehicle defects, traffic accidents, or official road closures, jpnboosted will attempt to reschedule. If this is not possible, jpnboosted will fully refund the booking fee paid.
9. Photo and Video Rights
The customer agrees that visual material may be created by the local partner during the tour, which jpnboosted may use anonymously (without naming the person) for marketing purposes on the website and social media, provided the customer does not explicitly object on-site.
10. Final Provisions
- The intermediary contract is governed by the laws of the Federal Republic of Germany.
- The exclusive place of jurisdiction for all disputes arising from the intermediary contract is Giessen, Germany.
- Should individual provisions of these T&C be invalid, the validity of the remaining contract shall remain unaffected.
